Amrapali La Residentia Flat Buyers Welfare Association

Welcome to “Amrapali La-Residentia Flat Buyers Welfare Association” (ALRFBWA) is registered association with Registrar of Societies(Registration No. GBN/02967/2020-2021) with objective to provide justice to the flat buyers of Amrapali La-Residentia project at Greater Noida West. Our key objective is to protect and fight for justice of all the flat buyers of La-Residentia project.

To provide you a background, Booking in this project was started in the year 2010 including from Tower No. 1 to Tower No. 39 with an assurance from Developer to complete this project latest by year 2013.

The flat buyers in the La-Residentia Project of Amrapali were fighting their individual cases in various courts and tribunals. Fighting individual cases against a big corporate entity like Amrapali was always a big challenge and a huge task.While the group of flat buyers already had put pressure on builder through means of meetings, emails and protests, it is equally significant to give it a legal standing by virtue of which the group may fight the case as a registered entity. Thus, a registered association represents all the flat buyers and decision making is more effective and is more efficient. Fighting cases individually is a costly affair and not within the reach of middle-class home buyers who has already put up their hard earned money to buy their dream homes.

“ALRFBWA” is fighting with builder on behalf of La-Residentia flat buyers for completion of project construction, developing facilities as per the Builder Buyer agreement (BBA) and providing possession of all flats along with Occupancy Certificate (OC)/Clearance Certificate (CC), and establish all the amenities as per the agreement made at the time of booking of our flats. Now, the project by La-Residentia builder has been untimely delayed rather defaulted on all commitments has failed from builder side since from year 2013 onwards and till date flat buyers are awaiting for their possession of flats. “ALRFBWA” case had moved to Hon’ble Supreme Court in the year 2020 to declare La-Residentia project as Amrapali Project, which further been moved to the National Company Law Appellate Tribunal (NCLAT) recently to drop against Corporate Insolvency Resolution Process (CIRP) proceedings against La-Residentia builder ordered by NCLT dated on 25.05.2022. It will be interest of all homebuyers to sincerely request to join their hands together with “ALRFBWA” to strengthen our fight against the builder for early completion of entire project as per the agreement. As each passing day, members are gradually increasing and home buyers are realising the benefits of coming together in joining the association, As a registered association has more weightage and representation and is recognized legally by all Government/Semi-Government authorities to protect the interest of all flat buyers and to further bring out transparency as well as accountability of stakeholders. Also, this would enable core members of the group to get contribution from group members/buyers in a traceable manner with complete book keeping.

Vision & Mission

Every individual home buyer was fighting against the builder in their individual capacity, but the problem was that all home buyers were disintegrated and fragmented and most were individual and clueless of the legal procedures and drafting the application prayer for filling case. The Registered Association was formed with common agenda of get the whole La-Residentia project successfully completed and getting the possession our flats legally as well as to keep the interest of all flat buyers protected.

Objectives of Association

To bring together all La-Residentia buyers under one umbrella and fight cases against the builder until completion of entire Project along with all amenities as per commitment and Agreement with buyer for which home buyers have paid to builder.
To represent all home buyers in various Courts, Tribunals, Government/Semi Government Authorities for taking up this project related matter/issues for the La-Residentia Project and arriving to the conclusion in more transparent and effective manner for benefits of home buyers.

Present Activities of the Association

After the Association was registered, the Association had filed an IA in ongoing Amrapali case in the Hon’ble Supreme Court in year 2020, the Hon’ble Supreme Court pronounced that the builder would carry out construction and complete the project.
After the judgment of 29.06.2021 pronounced by Hon’ble Supreme Court the builder was forced and was made accountable towards home buyer’s and the builder made commitment to complete the project by December 2022.
“ALRFBWA” was in regular touch and in communication with Ld. Court receiver in regards with project completion after the judgment of 2021 by Hon’ble Supreme Court.
ALRFBWA also had various meetings with senior officials of GNIDA Authority and UP RERA and submitted their representation for successful completion of Project after the Judgment passed by Hon’ble Supreme Court.
The Insolvency Proceedings, which was started under IRP Mr Jain, were quashed and dropped because of the initiative taken by the “ALRFBWA” by engaging Senior Advocate for filing IA in the NCLAT. Otherwise the future of our project under IRP would have been horrible and agonizing after long years of waiting time. Even during insolvency proceedings, the ALRFBWA has played a major role in providing assistance and completing of filling IRP procedures without charging the members.
Builder has failed in even restarting construction of the project and has only cheated us around with emotions of flat buyers after the judgment of 29.06.2021 and 20.05.2022. La-Residentia Builder has also failed to meet the compliance of UPRERA and GNIDA as directed by Hon’ble Supreme Court. Builder has only misdirected as well as wasted precious time of the buyers and all commitments/submissions made in Hon’ble Supreme Court vide affidavits or verbal communication with home buyers have proved wrong. In one of the order it was mentioned that no substantial development has taken place in the project.
In view of above all mentioned matters, the liabilities of builder is mounting up, GNIDA and UPRERA has conveyed to the ALRFBWA that builder has not submitted any compliance documents as directed by Hon’ble Supreme Court and authorities have not provided any relief to the builder in view of non-compliance.
After giving much thought and various meetings between association members, it was again decided to take a legal action, as the final solution to our remedies lies only in legal action and it was hence decided to take legal course of action at the earliest.
ALRFBWA wishes to represent all the home buyers representing from all towers i.e. Tower No. 1 to Tower No. 39 of La-Residentia Project to fight collectively for seeking justice and ensure proper representation is done by appointing more able SR, Advocate to fight our case for benefit of all home buyers.
